| Putting your home into a Revocable Trust is an estate planning best practice. Recently, issues arising from the LA wildfires highlighted a critical problem: homes held in trusts but not listed on insurance policies. This can lead to claim denials when disaster strikes.
If your property is held in a Revocable Trust, ensure the trust is listed as an "additional insured" on your insurance policy. Without this, your insurer may deny your claim for lack of "insurable interest," forcing you to fight back, possibly with an attorney. You can avoid this by contacting your agent, broker, or insurer and having them add the trust as an additional named insured. |
| To Do:
Contact your insurance agent/broker or insurer right after transferring property into a trust. Request that the trust be added as an additional insured on all your property insurance policies, including landlord, earthquake, flood, and hurricane policies. Ensure the trust's name matches exactly as it appears in your trust documents. Obtain written confirmation of this change from your insurance company and agent/broker.
